Welcome to Plantoscan! These Terms and Conditions govern your use of the Plantoscan mobile application (iOS and Android) and the Plantophiles website located at https://plantophiles.com, operated by Iseli International Commerce (Sole Proprietorship), registered in Switzerland.

By downloading, installing, or using the Plantoscan app or accessing the Plantophiles website, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.

These Terms apply to all users of our services. Our Privacy Policy, which is incorporated by reference into these Terms, also applies to your use of Plantoscan.

1. Definitions

The following definitions apply throughout these Terms and Conditions:

  • “Plantoscan”, “the App” — the Plantoscan mobile application available on the Apple App Store and Google Play Store.
  • “Service” — the Plantoscan app, the Plantophiles website, and all related features, tools, and content.
  • “We”, “Us”, “Our”, “the Company” — Iseli International Commerce (Sole Proprietorship), registered in Switzerland.
  • “You”, “Your”, “User” — the individual accessing or using our Service.
  • “Content” — any text, photos, images, data, or other material submitted to or displayed within the Service.
  • “Subscription” — a paid recurring access plan purchased through the App.

2. Eligibility and Account Registration

You must be at least 13 years of age to create an account or use the Plantoscan app. By using the Service you confirm that you meet this age requirement. If you are between 13 and 16 years of age, you confirm that you have obtained consent from a parent or legal guardian where required by applicable law in your jurisdiction.

You agree to provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. Mobile Application

The Plantoscan app is available on iOS (Apple App Store) and Android (Google Play Store). These Terms apply to your use of the app on both platforms. Your use of the app may also be subject to additional terms imposed by the relevant app store platform.

We reserve the right to update, modify, or discontinue the app or any feature within it at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

The app requires access to your device camera and photo library to provide plant identification and journaling features. Permission prompts will be displayed at the relevant time. You may revoke these permissions at any time in your device settings, though doing so will limit app functionality.

4. Subscriptions and Payments

Plantoscan offers both free and paid subscription tiers. Paid subscriptions are processed and managed through Apple App Store (iOS) or Google Play Store (Android) via RevenueCat.

4.1 Subscription Tiers

Details of available subscription tiers, features, and pricing are displayed within the app at the time of purchase. Prices are shown in your local currency and may vary by region.

4.2 Billing

Subscriptions are billed on a recurring basis (monthly or annually, depending on the plan selected). Your subscription will automatically renew at the end of each billing period unless cancelled. Your payment method on file with Apple or Google will be charged at the start of each new billing period.

4.3 Cancellation

You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation takes effect at the end of the current billing period — you retain access to paid features until that date. We do not offer refunds for partial subscription periods.

4.4 Price Changes

We reserve the right to change subscription prices with at least 30 days notice. Continued use of a paid subscription after a price change takes effect constitutes your acceptance of the new price.

4.5 Free Trial

We may offer free trial periods at our discretion. Trials automatically convert to paid subscriptions at the end of the trial period unless cancelled before the trial expires.

5. AI Features and Plant Diagnosis

Plantoscan uses artificial intelligence to provide plant identification, health diagnosis, care recommendations, and related features. By using these features you acknowledge and agree to the following:

5.1 Informational Purposes Only

AI-generated plant diagnoses, care recommendations, and health assessments are provided for informational purposes only. They do not constitute professional botanical, horticultural, or agricultural advice. Plantoscan is not liable for any plant health outcomes, financial loss, or damage arising from reliance on AI-generated content within the app.

For valuable, rare, or commercially significant plants, we strongly recommend consulting a certified botanist or horticulturalist.

5.2 AI-Generated Images

Some plant species images displayed within Plantoscan are generated by artificial intelligence using Google’s Gemini model. These images are created for illustrative purposes and may not represent the exact appearance of a specific specimen. AI-generated images are labelled as such where technically feasible.

5.3 Accuracy

While we strive for accuracy, AI-based plant identification may produce incorrect results, particularly for rare species, unusual specimens, or photos taken in poor conditions. We make no warranties regarding the accuracy, completeness, or reliability of any AI-generated output.

6. Plant Recognition Training Data

To improve the accuracy of Plantoscan’s plant identification technology over time and reduce our dependence on third-party identification services, we collect anonymised training data as follows:

  • Photos submitted for plant identification may be retained and used to train and improve Plantoscan’s own plant recognition models.
  • Before any image is used for training purposes, all personal data is permanently removed, including GPS location coordinates, device information, timestamps, and any other metadata embedded in the image (EXIF data).
  • No user identifiers are stored alongside training images. Training images cannot be traced back to individual users.
  • You may opt out of contributing anonymised photos to training data at any time via Settings > Privacy within the app. Opting out does not affect your ability to use plant identification features.

By using the plant identification feature without opting out, you consent to this use of anonymised, stripped images. This practice is consistent with industry standards and does not involve the collection or processing of personal data within the meaning of applicable privacy laws.

7. Community Feed and User-Generated Content

7.1 User Content Licence

By posting content to the Plantoscan community feed — including photos, text, comments, and any other material — you grant Iseli International Commerce (Sole Proprietorship) a non-exclusive, royalty-free, worldwide licence to display, distribute, reproduce, and promote that content within the Plantoscan app and related promotional materials. You retain full copyright ownership of your content.

7.2 Content Standards

You are solely responsible for all content you post. You warrant that:

  • You own or have the right to post the content.
  • The content does not infringe the intellectual property rights of any third party.
  • The content is not defamatory, offensive, obscene, or otherwise unlawful.
  • The content is not used to solicit, advertise, or promote commercial activity without our prior written approval.
  • The content is appropriate for a general audience including users aged 13 and above.

7.3 Moderation

Plantoscan does not review all content before it is published. We use automated moderation tools to screen for content that violates these Terms. We reserve the right, at our sole discretion, to remove any content that we determine violates these Terms or our Community Guidelines, without notice or liability. We are not obligated to respond to reports or take action within any specific timeframe.

7.4 Content Liability

User-generated content does not reflect the views or opinions of Plantoscan or Iseli International Commerce (Sole Proprietorship). We are not liable for any content posted by users, nor for any harm arising from your reliance on or exposure to such content.

8. Plant Passport and Data Transfer

The Plant Passport feature allows you to create a shareable digital profile for your plants and transfer it to another Plantoscan user.

  • When you transfer a Plant Passport to another user, the care history, photos, and health records associated with that plant are transferred to the recipient’s account. Your copy is archived.
  • Plantoscan is not responsible for the accuracy of information contained in a transferred Passport, or for any plant health outcomes following a transfer.
  • Transfer links are valid for 72 hours and may only be claimed once. We are not liable for expired or unclaimed transfers.
  • You must not use the Plant Passport transfer feature to misrepresent the identity, health, or provenance of a plant in connection with any commercial transaction.

9. Intellectual Property

Unless otherwise stated, Iseli International Commerce (Sole Proprietorship) and its licensors own all intellectual property rights in the Plantoscan app, the Plantophiles website, and all content produced by us. All rights are reserved.

You may not:

  • Copy, reproduce, or redistribute our content without prior written permission.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Plantoscan app.
  • Use our trademarks, logos, or brand assets without a trademark licence agreement.
  • Scrape, data-mine, or use automated tools to extract content or data from our Service.

10. Affiliate Links and Commercial Relationships

Plantoscan may display links to third-party products and services within the app, including plant care products, hardware, and marketplace listings. Some of these links may be affiliate links, meaning we may earn a commission if you make a purchase through them. This does not affect the price you pay or influence our recommendations. Affiliate relationships are disclosed where required by applicable law.

11. Privacy and Data Protection

Your use of Plantoscan is subject to our Privacy Policy, which is available within the app and at https://plantophiles.com/privacy. The Privacy Policy explains how we collect, use, store, and protect your personal data.

11.1 GDPR Rights (EU/EEA Users)

If you are located in the European Union or European Economic Area, you have the following rights under the General Data Protection Regulation (GDPR):

  • Right of access — request a copy of the personal data we hold about you.
  • Right to rectification — request correction of inaccurate personal data.
  • Right to erasure — request deletion of your account and all associated personal data. We will process deletion requests within 30 days. To request deletion, use Settings > Delete Account within the app or email us at [email protected].
  • Right to data portability — request your data in a machine-readable format.
  • Right to object — object to certain types of processing, including use of your data for training purposes (see Section 6).

Our services are governed by the laws of the Switzerland. Our legal basis for processing personal data is performance of contract (to provide the Service), legitimate interests (to improve the Service), and consent where explicitly requested.

11.2 Cookies

The Plantophiles website uses cookies to improve user experience and analyse traffic. By accessing the website, you agree to our use of cookies as described in our Cookie Policy. The Plantoscan app does not use browser cookies but may use device identifiers and analytics SDKs as described in the Privacy Policy.

12. Disclaimers and Limitation of Liability

To the maximum extent permitted by applicable law, Plantoscan and Iseli International Commerce (Sole Proprietorship) are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or available at any particular time.
  • Plant identification results will be accurate or suitable for any particular purpose.
  • The Service will be free from viruses or other harmful components.

Nothing in these Terms limits or excludes liability for:

  • Death or personal injury caused by our negligence.
  • Fraud or fraudulent misrepresentation.
  • Any liability that cannot be excluded under applicable law.

Subject to the above, our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid for your subscription in the 12 months preceding the claim, or EUR 50, whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless Iseli International Commerce (Sole Proprietorship), its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your use of the Service; (b) your breach of these Terms; (c) content you post; or (d) your violation of any applicable law or third-party rights.

14. Third-Party Services

Plantoscan integrates with third-party services including but not limited to: Google (Vertex AI / Gemini for image generation), Plant.id (plant identification), RevenueCat (subscription management), and Firebase (data storage and authentication). Your use of these integrations is subject to the respective third parties’ terms of service and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services.

15. Changes to These Terms

We reserve the right to update these Terms at any time. When we make material changes, we will notify you via a notice within the app or by email. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. The date of the most recent update is shown at the top of this document.

16. Termination

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if your conduct poses a risk to other users or the integrity of the Service. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination — including intellectual property, disclaimers, and indemnification — shall survive.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Switzerland. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the competent courts of the Switzerland, without prejudice to any mandatory consumer protection rights you may have under the laws of your country of residence.
